Unfortunately, they are still humans that are not immune to making mistakes. Nevertheless, if it can be proven that an incident occurred because of failure to perform a specific duty that is inherent in the profession or the performance of a procedure that is less than what the standards call for, then that professional can be held accountable for negligence. And when it comes to negligence, nothing is more serious than construction negligence.
The seriousness of construction negligence is largely related to the number of people who may have suffered injuries as well as the families of victims who may have lost their lives in the accident who are now seeking compensation for wrongful death. Additionally, there is also the issue of damage to property as well as economic losses because of construction negligence.
To put it into perspective, consider an owner who invested $100 million dollars to build a shopping complex only to see it reduced to a heap of rubble 3 months later with significant loss of life. Those who lost loved ones in the incident will definitely sue for wrongful death. Those who suffered injuries will also file for personal injury claims. The retailers who already have units in the shopping mall will also be considering filing for the appropriate civil case. The state, on the other hand, may find just enough reason to file for a criminal negligence case against the owner, the contractor, and virtually everyone who was involved in the construction of the shopping complex.
Conversely, the owner will be suing the general contractor who managed the entire building and construction project. And everyone will be literally suing everyone else. For the building owner, he did not only lose his $100 million investment. He also runs the risk of being criminally charged for negligence. Additionally, surrounding establishments that were partially damaged during the collapse can also sue for damages.
While the foregoing is an extreme example of the gravity of construction negligence, it almost always have two faces: one is related to personal injuries and the other is damage to property. Both will entail some form of monetary compensation for those who are aggrieved as well as for the recovery of economic losses stemming from the loss of revenue. This double-edged sword makes construction negligence a very serious matter in the legal and construction industries.
