Arduous deliveries can lead to birth trauma that is a result of negligence by the medical staff who facilitated the birth process and the consequences can be life changing.
For some women, having a child is the most exciting and happy time of their life.

For some women, having a child is the most exciting and happy time of their life. Sharing the news with their significant other, their friends and family and enjoying the pregnancy are all joyous occasions, and all they truly want most of all is for their infant to come into this world as healthy as humanly possible so that they may develop into a wide-eyed curious child with a wonderful childhood.

Every birth mother is well aware prior to going into the delivery room that giving birth to a child has its share of risks; there are possible complications with any birth. The possibility is heightened even more so when that is what the mother is focused on, and if there are prior known risks to the pregnancy it can cause severe anxiety in the delivery room.

Arduous deliveries can lead to birth trauma that is a result of negligence by the medical staff who facilitated the birth process and the consequences can be life changing. Attorneys who have experience in birth trauma understand that when the mother of the child is in distress during delivery, the medical staff should react with professionalism and compassion rather than with a knee-jerk reaction of negligent panic to relieve the situation of its complications. When the staff reacts hastily, injuries can occur to the mother and the child such as damaging the mother’s birthing canal and scratching or breaking the child’s limbs. In severe cases children have even exhibited brain damage. Any of these injuries to the mother or the child could be so severe that the result is a lifelong complication leading to financial strain from lost wages and increased or extended medical care.

Types of Birth Trauma

• Cerebral Palsy: There is no cure for this condition. It is caused when there is not enough oxygen in the brain during the delivery. This condition makes it difficult for a child to control their movements and often leads to further more serious medical complications as their life goes on.

• Erb’s Palsy: A stretching or ripping of the nerves that surround the infant’s shoulder and arm.

• Nerve damage: This occurs when the forceps that are used during delivery injure facial nerves which often results in paralysis. Other times it can include diaphragm nerve damage that can cause problematic breathing for the infant.

• Perinatal Asphyxia: This is when there is not enough blood flow to the fetus in utero, or a lack of oxygen in the blood. This can lead to permanent signs of neurologic damage including some learning disorders and slower development as severe as cerebral palsy.

When it comes to high risk pregnancies, every factor needs to be taken into consideration. If anything is overlooked by the physician who is responsible the result could harm the birth mother or the baby and negligence may play a factor in the injury. Issues that should have been assessed prior to the birth could very well put the mother and baby’s health in jeopardy, and thus, be grounds to get an experienced birth trauma attorney involved to compensate for hardships.

When birth trauma occurs for mother or child, it is necessary for families to recover financial compensation for their hardships that will include the cost of any additional medical bills and lost wages and future expenses due to the injuries incurred. Attorneys who have experience in birth injuries and trauma possess the compassion needed to handle these sensitive cases accurately and privately.
